The following are the terms under which Merrick Bank ("we", "us", or "our") offers you the ability to view and pay your Merrick Bank credit card account online (the "Service").

USE OF THE SERVICE. You may use the Service to view your Merrick Bank credit card Statement online to make individual online payments directly from an eligible checking or savings account in the amounts and on the days you request.

PAYMENT PROCESSING. Payments must be made by 11:59 p.m. ET to be credited as of that day but may take two business days to post.

LIMITATIONS ON FREQUENCY OF TRANSFERS. You will not be able to make payments using the Online Bill Pay Service more than once in any 24-hour period.

LIMITATIONS ON DOLLAR AMOUNT OF TRANSFERS. The minimum payment you will be able to make with the Service is $15.00 or the current balance on your account if it is less than $15.00. The maximum payment you will be able to make with the Service is your current account balance as reflected on the Account Summary page of the Merrick Bank Cardholder Center.

FEES. We will not impose a fee or other charge on you to use the Service. However, the financial institution at which you maintain your deposit account may charge you fees related to the maintenance of that account, including transaction fees or fees for attempting transfers without sufficient funds. As provided in your Cardholder Agreement, a charge will be assessed to your Merrick Bank credit card account for any payment that is returned unpaid by your bank.

CONFIDENTIALITY. We will disclose information to third parties about transfers you make with the Service: (a) when it is necessary for completing transfers; (b) in order to comply with government agency or court orders; and (c) as otherwise provided in our privacy policy.

PREAUTHORIZED PAYMENTS. No payment has been preauthorized because of your enrollment in the Service. If you want to make a payment using the Service, you must sign in and separately authorize each one or set up a automatic payment schedule. Your enrollment does not obligate you to use the Service as the only means of paying your Merrick Bank credit card account.

UNAUTHORIZED TRANSFERS. If you believe your password for accessing the Service has been lost or stolen or that someone has used or may use the Service to transfer money from your deposit account without your permission, notify us AT ONCE by calling us at 1-877-790-5648 or write to us at Merrick Bank P.O. Box 9201 Old Bethpage, NY 11804-9201 .

OUR LIABILITY FOR FAILURE TO COMPLETE TRANSACTIONS. If we do not complete a transfer you authorize on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages to the extent required by federal law. However, there are some exceptions. We will not be liable, for instance: (a) if, through no fault of ours, you do not have enough money in your deposit account to make the transfer; (b) if the system was not working properly and you knew about the breakdown when you started the transfer; or (c) if circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken. There also may be other exceptions stated in our agreements with you or provided by applicable law.

TERMINATION /CHANGE IN TERMS. We reserve the right, at any time, to cancel the Service, make additions or changes to these terms, or to cancel or suspend your use of the Service. When required by applicable law, we will provide you with a notice of any addition(s) or changes(s).
Notify Us in Case of Errors or Questions About Your Bill
If you think your bill or any specific transaction is wrong, or if you need more information about a transaction on your bill, write us on a separate sheet at Merrick Bank P.O. Box 9201 Old Bethpage, NY 11804-9201 . Write to us as soon as possible. We must hear from you no later than 60 days after we sent you the first bill on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights.
In your letter, give us the following information:

Your name and Account Number.

The dollar amount of the suspected error.

Describe the error and explain, if you can, why you believe there is an error. If you need more information, describe the item you are not sure about.
If you have authorized us to pay your credit card bill automatically from your savings or checking account, you can stop the payment on any amount you think is wrong. To stop the payment your letter must reach us three business days before the automatic payment is scheduled to occur.
Your Rights and Our Responsibilities After We Receive Your Written Notice
We must acknowledge your letter within 30 days, unless we have corrected the error by then. Within 90 days, we must either correct the error or explain why we believe the bill was correct.
After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent. We can continue to bill you for the amount you question, including interest charges, and we can apply any unpaid amount against your credit limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts of your bill that are not in question.
If we find that we made a mistake on your bill, you will not have to pay any interest charges related to any questioned amount. If we didn't make a mistake, you may have to pay interest charges, and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date that it is due.
If you fail to pay the amount that we think you owe, we may report you as delinquent. However, if our explanation does not satisfy you and you write to us within ten days telling us that you still refuse to pay, we must tell anyone we report you to that you have a question about your bill. And, we must tell you the name of anyone we reported you to. We must tell anyone we report you to that the matter has been settled between us when it finally is.
If we don't follow these rules, we can't collect the first $50 of the questioned amount, even if your bill was correct.
Special Rules for Credit Card Purchases
If you have a problem with the quality of property or services that you purchased with a credit card, and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining amount due on the property or services. There are two limitations on this right:

You must have made the purchases in your home state or, if not within your home state, within 100 miles of your current mailing address; and
-
The purchase price must have been more than $50.
These limitations do not apply if we own or operate the merchant, or if we mailed you the advertisement for the property or services.
